Yeah, he can flip depending on which way the wind blows. My guess is that he will not stick his neck out until there's a majority. I think Barrett may have some backbone on this and Roberts may prove to be reliable on this issue. So Alito's replacement would keep the score the same.
Thomas just hates the 14th amendment. He doesn't feel like it did him any good beacause, you know, billionaires lavishing gifts on him has convinced him that he is "one of the good ones" who don't need to worry.
I betcha if the Loving case was reintroduced, he would vote against it thinking that he would be above that too.
