Esquire calls out why Trump wants this settlment. The lawsuit requires him proving that he and the IRS are actually opposing parties and not on the same team. The judge has given him deadlines to present evidence in court to prove that. So far they haven't done it. So by settling he thinks he can avoid that.

Esquire calls out in theory the judge could still rule the settlement is not valid because Trump hasn't proven he's not working with the IRS, it's a novel case the judge has given Trump lots of leeway but he has not to date accepted that Trump has proven he's not just working in collusion with the IRS.
