18 U.S. Code Section 2101 in the federal code, inciting a riot is satisfied simply by urging or instigating others to riot:
to organize, promote, encourage, participate in, or carry on a riot; or (3) to commit any act of violence in furtherance of a riot.
He did it. And his statements show he meant to do it.
