two things. At the point where the guy actually dies, the train is empty except for 3 people, Penny, the guy he killed, and the 2nd guy helping Penny to restrain him.
That guy testified under oath he told Penny I will hold his arms if you let him go. He was already apparently holding the legs of the guy. His entire rationale was Penny said he was afraid to release the chokehold because the guy was still struggling and Penny said he was on drugs and thus very strong. The guy testified under oath he told Penny you're going to kill him if you don't release the choke
I don't think it was murder, but I also don't think it wasn't illegal. I hope the guys' family files a wrongful death suit against Penny
